Even though the Companies Act, 2013 governs most companies today, Producer Companies continue to be regulated under Chapter IXA of the Companies Act, 1956, as per Section 465 of the Companies Act, 2013. This provision will remain until a specific law is enacted for Producer Companies.
Meaning of a Producer Company
A Producer Company is formed by a group of producers—primarily farmers—engaged in activities such as production, procurement, grading, pooling, handling, marketing, export, and import of primary produce.
- Minimum Requirements:
- Members: Minimum 10 producers
- Directors: Minimum 5
- Capital: Minimum paid-up capital of ₹5,00,000
- Incorporated as a private company with restrictions as per Section 581B of the Companies Act, 1956.
